Our
systems may not be used to SEND or RECEIVE "spam" mailings
or be used as a means of correspondence for bulk mailings. Also, if
content of a client website is deemed questionable by our staff, we
immediately disable POP/IMAP e-mail access. Customers are also not to
use third party bulk e-mail services that direct traffic to their sites.
Such activity warrants immediate termination of account(s) without refund.
Some
questionable web sites include money making sites, multi-level marketing
sites, or obvious "too good to be true" type services. We
do not censor these type of accounts, however, accounts of this nature
may require a signed form with acceptance to company policies as said
herein if e-mail is required.
We
provide this policy up front to all of our clients and periodically
send it to all our clients via e-mail, and failure to adhere to our
policy is subject to immediate cancellation of the account. Setup fees
and/or remaining subscription funds are NOT refundable if such an event
occurs.
All
client web sites are subject to periodic inspection to not only monitor
up time quality for our clients but to assure the above policies are
adhered to.
The following is what we expect our customers to abide by. This document
is an ACTIVE Policy (or living document) since changes in the industry
can affect this policy at any time.
BlueberryDomain.net's
systems shall not be used to store or disseminate content of an obscene,
pornographic, racist, sexually explicit or extreme adult nature or provide
any links directly or indirectly to this type of material. NO BANNER
ADS to adult material are to be placed on any site as well. Nudity in
general is not acceptable. Some material may be acceptable but will
require prior approval by sending us e-mail at sales@bluecores.com.
Generally speaking, if your site has to have restricted access to prevent
minors from accessing it, then we definitely cannot host that site.
If you are not sure, please be sure to contact us. We are more than
happy to answer any questions or visit your current site before moving
it to our network. Please note that BlueberryDomain.net reserves the
right to audit entire sites for proper content on a regular basis. Sites
not found to follow this simple policy are subject to being immediately
shutdown without any prior notice. BlueberryDomain.net reserves the
right to not refund any remaining funds if any.
ADDITIONAL NOTE

Adult related sites affected by this policy will include any and all
sites that are sexual in nature and inappropriate for children. The
constitution protects your right of free speech and the Uniform Commercial
Code protects our rights to do business with whom we choose. We'll respect
your rights, please respect ours.
BlueberryDomain.net's systems shall not be used for gambling, to host
ADVANCED FEE FRAUDS sites or any other practice deemed illegal by the
laws of any of the States of The Federal Republic of Nigeria. This includes
content that is stolen, pirated or unlicensed copyrighted material.
BlueberryDomain.net does not allow customers to point to illegal material
- which includes banner ads, software duplication how to sites, etc..
(other examples of sites we do not allow are: Sites dealing with promoting
game consoles or any site catering to duplicating software of any kind)
These sites are illegal in our state as still promote the act of duplicating
software.
BlueberryDomain.net does not allow the use of third party DNS servers
to point to our network. The use of these services will force us to
terminate your account without any notice required. Only BlueberryDomain.net's
DNS servers may be used for your domain and for your security as well.
There are no exceptions.
All
BlueberryDomain.net customers are responsible for moving their domains
by pointing their domains to our network.
Copyrighted music or sounds in .WAV or especially .MP3 format is not
acceptable. Only public domain sound files are allowed. If your sound
file(s) are copyrighted by you or your company, please contact us for
approval first. Sites that point to copyrighted material are strictly
forbidden.
BlueberryDomain.net's systems shall not be used to store or disseminate
material of a threatening or slanderous nature. BlueberryDomain.net
does not tolerate sites that promote discrimination of any kind. Sites
of this type will require immediate termination of service.
Customers
are not allowed to use our service to redirect to content that goes
against our policies. For example, we do not allow portal sites be set
up with adult material being stored on other servers. The content policy
still applies.
BlueberryDomain.net's systems shall not be used to send spam (unsolicited
e-mail) or receive replies to spam. Such actions will result in immediate
termination of service without prior notice required. This applies to
sending mail through our network to a third party mail service or if
a third party spam service is used to link to a BlueberryDomain.net
account. BlueberryDomain.net can disable an account to protect the integrity
of the network due to Denial of Service Attacks, or attempts to spam
through the customer account as well. In short, if you need to use SPAM
or bulk unsolicited e-mail for your advertising, we cannot be your hosting
provider.
BlueberryDomain.net
customers are not to "poll" for e-mail every second or every
minute of the day due to the unnecessary stress it can cause on mail
servers. Our servers poll for new e-mail every hour so it is not necessary
to poll frequently anyway. We appreciate your help in keeping your assigned
mail server easy to access for all customers.
BlueberryDomain.net does not allow a customer to resell e-mail addresses
on their virtual mail server. Our service is not to be used as a "hotmail"
or "yahoo mail" type service. The performance is tuned for
customers using mail for their own private use and not for public use.
If you need to establish a mail server service, then we can negotiate
a higher performance service/server for your needs. Otherwise you can
opt to outsource your mail to a third party e-mail provider. If you
are giving away e-mail addresses then you must seek permission from
us as we may have to negotiate a different feature set for you as well.
Yes, you may have as many accounts as you wish with our standard accounts,
but you also should note performance can degrade with a simple virtual
server being abused as though it were a full blown server. BlueberryDomain.net
does reserve the right to limit your number of accounts if this policy
is obviously abused.
BlueberryDomain.net is not responsible for customer e-mail if mail is
configured to forward to another ISP. Once mail leaves the BlueberryDomain.net
network we cannot guarantee that the receiving ISP will deliver mail
in a timely manner. If mail is lost by the other ISP, again, BlueberryDomain.net
is NOT responsible.
BlueberryDomain.net cannot guarantee that e-mail will be sent or received
instantaneously. BlueberryDomain.net systems are tuned to perform as
best as current technology allows. However, there are many times that
mail can be delayed for a few minutes or a few hours if it is a particular
peak period of time. This is normal on the internet and most of the
time delays are due to outside influences like network latency or slower
networks outside BlueberryDomain.net's fast data center.
BlueberryDomain.net, which provides your server/site, reserves the right
to deactivate any virtual server account, if the account is in violation
of BlueberryDomain.net operational procedures.
We reserve the right to refuse service, to anyone, for any reason, and
at any time, in order to ensure a professional environment for all of
our clients. BlueberryDomain.net will refuse service immediately to
any customer who uses excessive profanity, makes personal attacks, or
is not professional in such a way that is condescending to any BlueberryDomain.net
employee. Any form of legal threat also equates to an immediate termination
of the client's account. ALL CORRESPONDENCE THAT IS EVEN REMOTELY CLOSE
TO BREAKING THIS POLICY ARE KEPT ON RECORD FOR UP TO 3 YEARS.
We do not accept uploading of custom DLL's to our NT servers. (This
applies to ISAPI filters too) This protects all clients that share each
server from potential server failure. Not allowing custom software,
dll's or applications to be added to our servers protect not only BlueberryDomain.net,
but the client from legal issues that can arise as well.
All customers are responsible for keeping BlueberryDomain.net up to
date on a proper contact e-mail address for their BlueberryDomain.net
web site account.
BlueberryDomain.net does not assist in the design or creation of web
sites except one which was explicitly contracted to BlueberryDomain.net
to design. (This also applies to database consultation of any kind)
If special site modifications or source code evaluation are required
by BlueberryDomain.net, we reserve the right to charge at a competitive
hourly rate. We may also refer customers to trusted web site development
companies if required.
If the customer uses Storefront or any other e-commerce solution, BlueberryDomain.net
is not responsible for providing debugging or web site development support.
It is up to the customer to obtain proper support from the vendor or
professional consultant for such needs. With regards to storefront,
BlueberryDomain.net is authorized to install storefront technology components
once a customer signs up for such a service. After the components are
installed, the customer is solely responsible for coding their own site
to work with the proper components.
BlueberryDomain.net does allow the use of outside mail servers through
our DNS servers at a nominal service charge. However, BlueberryDomain.net
is not responsible for mail problems outside of our network since BlueberryDomain.net
cannot control how the third party server or service handles mail.
Non-BlueberryDomain.net
customers cannot use BlueberryDomain.net's name, address, phone number
or any other content information for their domain contact information
without prior written permission. If a non-BlueberryDomain.net customer
"parks" a domain using our dns information or our technical
contact information, BlueberryDomain.net reserves the right to bill
the domain owner and/or take legal action. This is called domain "squatting".
Static IPs: If a customer has a static IP assigned to their account,
the customer cannot use any third party network routing to that IP.
This includes mail and web traffic routing. Customers must still use
BlueberryDomain.net's DNS servers with or without a static IP. BlueberryDomain.net
reserves the right to disable a customer's static IP if this rule is
not followed or if there is any abuse found.
The terms and conditions of the BlueberryDomain.net Service Contract
has been read and understood by all BlueberryDomain.net customers.
Web cams are acceptable, however, the interval for uploading cannot
be less than 5 minutes. If BlueberryDomain.net notices a substantial
performance loss on the server due to web cam usage, BlueberryDomain.net
reserves the right to recommend a higher end service to accommodate
the stress of the web cam uploads.
BlueberryDomain.net cannot be held responsible for damages done by e-mail
viruses. It is the customer's responsibility to own and maintain local
copies of anti-virus software.
BlueberryDomain.net customers are to not use any third party tools to
monitor or ping tests against their sites at all. Doing so adds unnecessary
stress on your site and can potentially bring it down. We do not allow
any web monitoring tools to monitor web site status at all. Ping (ICMP
Traffic) is blocked at the firewall, to protect our servers and our
customers from attacks using this protocol. At BlueberryDomain.net,
we staff our network operations center with qualified and professional
staff who are responsible for monitoring your site. Third party services
or any tool outside of our network are not capable of monitoring any
site 100% due to the unpredictable nature of the internet anyway. Do
not pay for monitoring services, they are a waste of your money to be
honest with you.
BlueberryDomain.net does not allow or recommend heavy download sites
to be used on our shared services. Heavy download sites can saturate
an entire server and could cause problems for not only the customer
but for all customers on the same server. If you are providing a service
to download files of any kind and in high volume, you will need permission
from us to host your site. No exceptions. However, your site may be
short lived on our servers or even any other shared host due to the
high number of users such a site requires at the same time. Sometimes
more so that can affect others on the same server. Recommendations will
be given or if we will be able to service your needs. BlueberryDomain.net
only wishes your satisfaction, and sites that do exclusive or excessive
downloads are sites that should be on dedicated servers, not shared.
Example heavy sites that are not recommended and should be on their
own servers include: image sites, sites with mp3s, exe's, or zip files,
or mirror sites for shareware or other commercial software. If your
site does a lot of downloads please contact us first. It is not the
traffic we are concerned with but the sustained user rate that is substantially
higher than that of a regular web site without downloads. If your site
gets a couple downloads a day that is certainly far different from a
sustained level of downloads. Performance is key, not just bandwidth
in the case of download sites. (Not everyone can download from dsl or
cable modem! Its the high chance you will have many modem users downloading
for an extended period that can hurt your performance on any shared
hosting company). Which saturates not just your site, but the entire
server due to sustained usage - which is far more of a performance hog
than that of a strict html sites getting hundreds of visitors an hour.
BlueberryDomain.net does daily scans for "un-linked" files
for potential abuse. Please note this as we do scan for clients hiding
illegal material. As a customer you approve of such standard auditing
practices as it is the law. BlueberryDomain.net reserves the right to
shut down a customer site if this rule is not followed in order to protect
other customers on the same server.
BlueberryDomain.net customers are NOT to call any BlueberryDomain.net
employee at their homes for ANY reason. BlueberryDomain.net provides
low pricing by offering free online support via e-mail and online chat
as available. Calling employees at home is not acceptable and can result
in immediate termination of your account.
Modification
------------
BlueberryDomain.net reserves the right to add, delete, or modify any
provision of this Policy at any time without notice. Any party seeking
to report any violations of BlueberryDomain.net policy may contact via
e-mail: abuse@bluecores.com
The customer understands that once they sign up for service, payment
is required regardless if they choose to utilize the web site or not.
BlueberryDomain.net is not responsible for the customer not registering
a domain name, not pointing their domain name to our servers, or not
putting content on the site.
IF YOU, YOUR CUSTOMER, OR YOUR BUSINESS IS LOCATED IN ANY OTHER COUNTRY
CURRENTLY ON THE FEDERAL REPULIC OF Nigeria’s BUREAU OF EXPORT
ADMINISTRATION'S LIST OF EMBARGOED COUNTRIES, ARE A PARTY ON THE TABLE
OF DENIAL ORDERS, OR ARE ENGAGED IN THE PROLIFERATION OF NUCLEAR, CHEMICAL
OR BIOLOGICAL WEAPONS OR MISSILES, BlueberryDomain.net WILL NOT ACCEPT
YOUR BUSINESS.

RESERVES THE RIGHT TO DELETE ACCOUNTS (WITHOUT REFUNDS) THAT VIOLATE
